Statutory liability for defects

The statutory liability for defects (legal guarantee) applies to all items purchased from us. We are liable for the goods being free from defects at the time of delivery.

Periods for consumers

  • New goods: 2 years from delivery.
  • Refurbished or used goods: 1 year from delivery if this was expressly and separately agreed when ordering; otherwise 2 years. Refurbished and used items are marked on the product page.
  • If a defect becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery.

Your rights in the event of a defect

You may first demand subsequent performance – at your option, remedy of the defect or delivery of a defect-free item. If subsequent performance fails or is unreasonable, you may withdraw from the contract or reduce the purchase price. In addition, you may claim damages or reimbursement of futile expenses in accordance with statutory provisions.

What is not a defect

Liability covers defects that existed at the time of delivery. It does not cover damage and wear that arise only after delivery, for example:

  • natural wear depending on use (laser pickups age with operating hours),
  • damage caused by improper installation, e.g. electrostatic discharge, an incorrectly set laser current or operation with the protective solder bridge still in place,
  • consequential damage from another defect in the device (e.g. power supply, motors, control circuitry).

Business customers

For business customers, the period for claims for defects is one year from delivery – for new, used and refurbished items alike. Merchants must inspect the goods promptly after receipt and report defects without delay. Details are set out in our terms and conditions.
